Mashpee Zoning
Board of Appeals Minutes
• 3 August 22, 2007
fashion in order that opposing counsel can review it. The matter is continued until
September 12, 2007.
Paul Hovsenian: Requests a Variance from Section 174-31 of the Zoning By-laws in
order to expand the existing dwelling on both first and second floor whereby first floor
addition of 28' x 10' requires frontyard setback relief and sideyard setback relief on
property located in an R-3 zoning district at 6 Forest Road (Map 117 Parcel 55) Mashpee,
MA.
Sitting: Robert Nelson, Zella Elizenberry, Jonathan Forbush, James Reiffarth and
George Bolton.
Paul Hovsepian represents himself at this hearing. He is seeking a variance on his
sideyard in order to add a second floor onto a small house and a bump out for a porch on
the first floor. The Board reviews the plans and finds the lot to be only 7,500 square feet.
It is noted that the house is very small to start with and he needs more living space. The
second floor addition will be 2809 and 10 feet of the first floor bump out is where the .
variance is need since he cannot maintain the 15 foot setback. His septic system can
maintain a 5 bedroom house with is fine. He is also at 19.7% for his lot coverage, He is
seeking 4.8 feet to the side and the Board wishes to clean up the fronyard setback and
will also issue at 2.5 foot variance in the front. Zella Elizenberry makes a motion to grant
the requested variances. Robert Nelson seconds the motion. All agree. Reference plans
• from Cape & Islands Engeering dated July 24, 2007.
Gail Lopes: Requests a Variance from Section 174-32 of the zoning by-laws to seek
relief from the common driveway to be paved on property located in an R-5 zoning
district at 27 Melissa Avenue (Map 21 Parcel 13 A & B), Mashpee, MA.
Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and
George Bolton.
Gail Lopes represents herself at this hearing. She has been before the Board recently and
obtained a variance for the lot size which was granted. Now she was told she needed to
come back to the ZBA for the paving of the common driveway. Fire Chief George Baker
has submmited a letter in support stating that the widening of the approach of the
driveway is acceptable and has the shape of "T" and adequate room for turning and fire
apparatus. The Board agrees with the Fire Chief. Jonathan Forbush makes a motion to
grant the Variance that relieves them of the burden of paving the driveway. Robert
Nelson seconds the motion. All agree. So moved. Reference plans from J.E. Launders
Cauley of West Falmouth, MA, dated August 10, 2007.
u
