{ 016'N a <br />lown <br />Mashpec <br />MASHPEE ZONING BOARD OF APPEALS 16 �f eat Neck load J�or th <br />Mashpee, NlossachUS(WS 02649 <br />DECISION FOR A VARIANCE <br />RE: Kimberly Cramer <br />250 Fells Pond Road <br />Map 116 Parcel 34 <br />V-07-62 <br />A Petition was filed on September 11, 2007 for a Variance from Section 174-31 <br />of the Zoning By-laws for permission to vary the sideline setbacks and landspace <br />requirements in order build a new dwelling on property located in an R-3 zoning district <br />at 250 Fells Pond Road (Map 116 Parcel 34) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on September 21, 2007 and <br />September 28, 2007, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, October 10, 2007 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br />Jonathan Furbush, James Reiffarth and George Bolton. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Doug Stefanov represents the applicant at this hearing. They are seeking a special <br />permit to demolish the existing dwelling and replace the house. Once the existing house <br />is razed, the lot will not be in line with the current zoning that requires vacant lots to be <br />40,000 square feet in that district. Applicant is requesting a variance for landspace relief, <br />and setback requirements in that the applicant is burdened with two frontages both <br />requiring a 40 foot setback. The proposed house is 30 feet from Fells Pond Road and is <br />basically no more detrimental than the existing dwelling that sits at 29.1 feet from Fells <br />Pond Road.
