I� <br />Town of M-ashpec <br />MASHPEE ZONING BOARD OF APPEALS 16 Givat Neck load ,.1Vor-th <br />-Voshpee,-Allossachusetts 02649 <br />Decision for a Special Permit <br />Tiffany Mendes <br />225 Asumet Road <br />Map 26 Parcel 15 <br />SP-07-61 <br />A Petition was filed on September 7, 2007 for a Special Permit under Section <br />174-45.4 of the Zoning By-laws to build an accessory apartment on property located in <br />an R-5 zoning district at 225 Ashumet Road (Map 26 Parcel 15) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, September 21, 2007 and <br />September 28, 2007 a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, October 10, 2007 at which time the following members of the Zoning <br />Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br />James Reiffarth, Jonathan Fiubush and George Bolton. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />Carmen Shay of 185 Ashumet Road informs the Board that he is no longer <br />representing them as their engineer. He had done some work on the plans but is not in a <br />working relationship with them at the moment. He is not opposed to the project. Joe <br />Gallant speaks also — 215 Ashumet Road — and questions whether the apartment is going <br />above the detached garage or the garage attached to the house on the set of plans. Ms. <br />Mendes informs him it is going on the garage attached to the house. The Board also <br />stipulates that no other accessory dwelling can be built on that lot. After some further <br />review of the plans, Zella Elizenberry moves to grant the Special Permit. The Board <br />stipulates that plans from Carmen E. Shay Environmental Services, Inc., dated December <br />15, 2006 must be complied with and the proposed outbuilding never be used for housing <br />— storage only. <br />
