Mashpee Zoning <br />Board of Appeals Mintues <br />1 October 10, 2007 <br />• TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, October 10, 2007 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, October <br />10, 2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry, <br />Jonathan Furbush, James Reiffarth and George Bolton were present along with alternate <br />member William Blaisdell. Alternate Member Martin Gordon was absent. <br />Robert Nelson opens the hearing at 7:00 p.m. <br />Tiffany Mendes: Requests a Special Permit from Section 174-45.4 of the Zoning By- <br />laws in order to build an accessory dwelling above a proposed garage on property located <br />in an R-5 zoning district at 225 Ashumet Road (Map 26 Parcel 15) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and James <br />Reiffarth. <br />Tiffany Mendes represents herself at this hearing. She is asking the Board for a Special <br />• Permit for an accessory structure above the proposed attached garage she is building. <br />The Board of Health has allowed 5 bedrooms — the apartment can be up to 2 bedrooms. <br />A question was raised what the measurement — it is 26.4 from the concrete slab to the <br />peak. <br />Carmen Shay of Ashumet — he informs the Board that he is no longer representing them <br />as their engineer. He had done some work on the plans but is not in a working <br />relationship with them at the moment. He is not opposed to the project. Joe Gallant <br />speak also — 215 Ashumet Road questions whether the apartment is going above the <br />detached garage or the garage attached to the house on the set of plans. Ms. Mendes <br />informs him it is going on the garage attached to the house. The Board also stipulates <br />that no other accessory dwelling can be built on that lot. After some further review of the <br />plans, Zella Elizenberry moves to grant the Special Permit. Jonathan Furbush seconds <br />the motion. All agree. So moved. The Board stipulates that plans from Carmen E. Shay <br />Environmental Services, Inc., dated December 15, 2006 must be complied with and the <br />proposed outbuilding never be used for housing — storage only. <br />Richard Winslow: Requests a Variance from Section 174-31 of the Zoning By-laws in <br />order to alter/replace an existing deck and is seeking.side-yard setback relief on property <br />located in an R-5 zoning district at 35 Mohican Avenue (Map 72 Parcel 69B) Mashpee, <br />MA. <br />• Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and James <br />Reiffarth. <br />
