Mashpee Zoning <br />Board of Appeals <br />Minutes <br />• 4 December 12, 2007 <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, George Bolton and James <br />Reiffarth. <br />Brian Harris from Bennett Engineering represents the applicants at this hearing. They <br />are seeking a special permit to alter a pre-existing non -conforming structure and a <br />variance for setback relief from a pre-existing deck that was there when they purchased <br />the house. It sits at 8.4 feet off the lot line, but applicant is not making it anymore <br />detrimental or pushing it closer to the lot line. The Board reviews the plans and discusses <br />with Mr. Harris whether the setback is 10 or 15 feet. The Board informs him that it is not <br />• <br />a cluster subdivision and the new construction of the garage must be 15 feet from the lot <br />line. The Board would like to see the garage pushed back farther so no variance is <br />needed. Mr. Nelson reads a letter in to the record from Marilyn Sinkiewicz who abuts the <br />applicant on the side where the existing deck is. She is opposed to a variance being <br />granted and states "she does not want another structure built closer to my lot line." Mr. <br />Nelson asks Mr. Harris if they can clip the corner of the deck to at least make it 10 feet <br />from the neighbors lot line. Mr.Sawyer, the builder, says they can do that no problem. <br />They will also push the garage to 15 feet. They also discuss the entrances — the owner <br />would like to keep both the circular driveway and the regular one. Mr. Harris also says <br />they. need to go to Conservation tomorrow evening and that while the ZBA would grant <br />their requests conditioned on approval from Conservation, there are changes the ZBA <br />needs to see made and ask that this be continued until January 9" to approve all the <br />changes and have them get through conservation as well. All agree.to this and both the <br />special permit and variance request will be continued until January 9, 2008 . <br />Lori Corsi reminds the Board there is no hearing on December 26, 2007. The next <br />hearing will be January 9, 2008. Jonathan Furbush will be in Florida fyi. <br />Zella Elizenberry makes a motion to approve minutes from November 28, 2007 as <br />amended by Bob and Lori. Jonathan Furbush seconds the motion.
