PROCEDURAL HISTORY AND JURISDICTIONAL FINDINGS <br /> 1. Application for so-called Comprehensive Permit received by the Mashpee Zoning <br /> Board of Appeals (the "Board") on December 1, 2005. The application is for 382 <br /> housing units and approximately 40,900 square feet of commercial and office <br /> space adjacent to a nixed-use development Imown as Mashpee Commons, which <br /> is located at the rotary which forms the intersection of Route 28 and 151 (and <br /> other roads). The Application proposes several different housing types as well as <br /> a mix of rental and home-ownership units. The Application also proposes limited <br /> associated commercial on the Property (the "Project"). The original Application <br /> materials included a bound book, entitled "Jobs & Whitings Neighborhoods, <br /> Mashpee Commons, January 17, 2006, Town Book Compilation," which <br /> described the project and contained a variety of plans and tables (the "Town <br /> Book"). The Application also included a so-called "project eligibility letter" from <br /> MassHousing. <br /> 2. The Applicant is a limited dividend corporation. Accordingly, the jurisdictional <br /> requirements under 760 CMR 31.01(1)(a) have been satisfied. The Applicant is <br /> an entity that is substantially related to the entity that evelpp ed the adjacent <br /> Mashpee Commons commercial center.LE: Id <br /> 5 � L�' <br /> final permit 1 <br />
