t6.'[UIIM1M�. <br /> %y <br /> Town of Mashpce <br /> '( E <br /> - y MASHPEE ZONING BOARD OF APPEA L86 (great,.Vl ck (koad A)r-th <br /> JWaslrpee, Massachusetts 02649 <br /> Decision for a Variance <br /> Re: Cape Cod Appliance, Inc. 17 Cape Drive <br /> Map 55 Parcel 20 <br /> V-06-12 <br /> A Petition was filed on January 5, 2006 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current lot size and frontage requirements on property located <br /> in an C-2 zoning district at 17 Cape Drive (Map 55 Block 20) Mashpee, MA. <br /> Notice was duly giveii to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on January 13, 2006 and January 20. 2006, a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 22,2006, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brern, Frederick Borgeson and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represents the petitioner at this hearing. This property <br /> was granted a variance in 2004 for the same request but expired. Applicant is now <br /> seeking the sane request to allow the lot to become buildable for a commercial building <br /> which it is zoned for. The slu•roLuiding lots have similar buildings and this would be <br /> appropriate to grant since it was previously granted but expired. The Board reviewed the <br /> plans and the older decision. They moved to grant a 75 foot frontage variance and an <br /> 11,892 square foot landspace variance. <br /> 1 <br />
