Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on March 24, 2006 and March 31, 2006, a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, at which time the following members of the Zoning Board of Appeals were <br /> present and acting throughout: Robert Nelson, Frederick Borgeson, Jonathan Furbush, <br /> James Reiffarth and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Craig Martin represents the applicant at this hearing. The applicant had <br /> applied previously for a variance for this existing illegal deck which was granted but the <br /> variance expired. They are before the Board again asking for the same variance relief. <br /> The deck was with the house when the applicant purchased the house. The Board makes <br /> a motion to grant a 6.9 foot variance in the rear and a 6.1 variance on the sideyard. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 10 Seneca Avenue and contains 9,000 <br /> square feet. <br /> f <br />
