16 Gi cwt WVeck Poad eM)f~tl� <br /> MASHPEE ZONING BOARD OF APPEALklashpee, Massachusetts 0,9649 <br /> Decision for a Special Permit <br /> RE: Debra Lee Quigley 384 Monomoscoy Road <br /> Map 125 Parcel 20 <br /> SP-06-23 <br /> A Petition was filed on March 9, 2006 for a Special Permit under Section 174-25 <br /> (I) 1 of the Zoning By-laws to allow an entertainment room above the garage and modify <br /> the conditions in A-02-76 on property located in an R-3 zoning district at 384 <br /> Monomoscoy Road (Map 125 Parcel 20) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 24, 2006 and March <br /> 31, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 12, 2004, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, <br /> Marshall Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the petitioner at this <br /> hearing. There exists an Appeal to overturn the Building Commissioner's decision in <br /> 2002 from which a Special Permit was originally granted in 1999 for a house and garage <br /> to be built with no living space above. They are before the Board this tonight to rectify <br /> what turned into a confusing situation for the space above the garage. The Building <br /> Inspector at the time Russ Wheeler, informed Mr. Quigley that he needed to close off the <br /> section of the barn/garage and now it appears to be considered living space. The Board <br /> would to Imow what the intension of the resident is since this appears to look like an <br /> apartment. The Board questions about the potential use and what it is now. They have <br /> l <br /> indicated that they will only allow the space to be used for office use. To clarify the use <br /> of the permit, it is decided that the existing room shall be modified from the A-02-76 to <br />
