fff,listc'N op <br /> alown of Nashpce <br /> c :Is <br /> Ulshpce, Allassach.usettes 02649 <br /> �A�,I�T,L.� MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Sally Prucha 4 Katian Way <br /> Map 2 Parcel 152 <br /> V-06-37 <br /> A Petition was filed on April 18, 2006 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current setback requirements in order to build a garage on <br /> property located in an R-5 zoning district at 4 Katian Way (Map 2 Block 152) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on April 28, 2006 and May 5, 2006, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 24, 2006, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Jonathan <br /> Furbush, Frederick Borgeson and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Sally Prucha represented herself at this hearing. She would like to build a garage <br /> and cannot meet the setback requirements on her lot due to some topography issues. The <br /> Board reviews the plans agrees this is the least detrimental spot to build the garage. The <br /> Board of Health has issued no habitable space above the garage. The Board makes a <br /> motion to grant the following variances: <br /> ✓ A 17.3 foot variance on the northerly side <br /> ✓ A 4.9 foot variance in the rear <br /> Y <br />
