Patrick Riley 30 Shorewood Drive <br /> Map 58 Parcel 37 <br /> SP-06-38 <br /> A Petition was filed on May 8, 2006 for a Special Permit under Section 174-45.4 <br /> of the Zoning By-laws to legalize an existing accessory apartment on property located in <br /> an R-3 zoning district at 30 Shorewood Drive (Map 58 Parcel 37) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, May 12, 2006 and May 19, <br /> 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2006 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush, Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Riley represents himself at this hearing. He is seeking to legalize an <br /> apartment he has had in his home for many years. He submits floor plans to the Board <br /> for review. He has been through Design Review and since this is in his basement there is <br /> no comments on the design at this point. Mr. Brem mentions his strong concern about <br /> residents having these illegal apartments for many years and collecting rent without <br /> paying the assessed taxes on the apartment. The Board discusses this at length and <br /> inquires about certain permits that were seemingly not obtained either. After much <br /> discussion, the chairman asks for a vote. The matter is denied 3-2. However, at the end <br /> of the hearing, the matter is brought up again and discussed. The Chairman would like <br /> the two new board members who voted against this matter to review the by-law and <br />
