Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on June 16, 2006 and June <br /> 23, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 28, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicants at this <br /> hearing. They are seeking variances in order to rebuild a house they are going to tear <br /> down. Although the frontyard setback is basically what is existing now, it is still non- <br /> conforming to the current zoning. The applicant is burdened with a corner lot which <br /> necessitates two 40 foot frontyard setbacks. Once the existing dwelling is torn dowel, the <br /> lot will not be large enough to maintain the current zoning of 40,000 square feet. After <br /> reviewing the plans the board feels the criteria is met and makes a motion to grant the <br /> following: <br />
