F 011'N <br /> a s <br /> ]own of Nashpcc <br /> 16 f�f-cat Nck. �oacl,.A{)rth <br /> AlIashpce, A lIassachusetts 02649 <br /> nnukco MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Michael Moskowitz 146 Popponesset Island Road <br /> Map 112 Parcel 10 <br /> SP-06-51 <br /> A Petition was filed on June 21, 2006 for a Special Permit under Section 174- <br /> 25.1.9 of the Zoning By-laws for permission to modify the existing permit of(SP-96-33) <br /> to reposition two existing piles, replace existing ramp with 3' x 30' ramp, rotate existing <br /> 6' x 20' float and install 4 new piles in Popponesset Creels on property located in an <br /> R-3 zoning district at 146 Popponesset Island Road (Map 112 Parcel 10) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on June 30, 2006 and July 7, <br /> 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was'scheduled on July 12, 2006 and continued until August 23, <br /> 2006 at the Mashpee Town Hall at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, George Bolton, <br /> Eric Dublirer, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the Applicant. <br /> They were granted a previous Special Permit but it has lapsed and they would like to <br /> make a modification to the float. Applicant would like to turn the float to a 90 degree <br /> angle which would in no way extend this out any further. Mr. Slavinsky shows the Board <br /> what he means with an exhibit to show the angle of the projected float turn. The Board <br /> feels this is appropriate and moves to grant the special permit. The revised plan has been <br /> approved by the Harbormaster, the Shellfish Constable and the Conservation <br /> Commission. <br />
