Owner of Record: Town of Mashpee <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 28, 2006 and August <br /> 4, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 2004, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Eric <br /> Dublirer, Jonathan Furbush and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Paula Schnepp, Director of the Cape Cod Free Clinic represents the applicants at <br /> this hearing along with Tim Santos of Holmes & McGrath. The Clinic is seeking to build <br /> a new building on land that was given to them by the town of Mashpee. There was a total <br /> of 4.6 acres originally granted. The clinic is looking to lease 2.6 acres of the land and <br /> give the remainder back to the town. Selectman John Cahalane spoke on behalf of the <br /> Board of Selectman supporting this endeavor for the benefit of the town. He also <br /> informed the ZBA that the Board of Selectman had voted to release as much of the land <br /> as the Clinic would need to use. Mr. Nelson asks if there is a recordable plan. There is <br /> not yet as they are still questioning the set up. They would like to have a 99 year lease <br /> and should obtain a recordable lease as soon as possible.
