4own of Mash cc <br /> 16 Cyr ectt .Xeck lt�o ad JAM tEt, <br /> A�,,� Mashpee, MCISsachUsetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> Re: Robert Flaherty One Anthony's Way <br /> Map 88 Parcel 101 <br /> SP-06-61 <br /> A Petition was filed on July 18, 2006 for a Special Permit under Section J 74-45.4 <br /> of the Zoning By-laws to build an accessory apartment on property located in an R-3 <br /> zoning district at One Anthony's Way (Map 88 Parcel 101) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, July 21, 2006 and July 28, <br /> 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing washeld on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 9, 2006 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Zella Elizenberry, Marshall Brem, <br /> Jonathan Furbush, Eric Dublirer and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Eric Lubrano represents the applicant at this hearing. They are seeking a special <br /> permit in order to build an accessory apartment. They are able to meet the setback <br /> requirements and the lot coverage is way under the 20% maximum. Applicant is <br /> restricted to the current number of bedrooms in the existing house and must open up one <br /> of the bedrooms to a 6 foot opening. Mr. Brem would like to see the closet sealed as <br /> well. Mr. Lubrano agrees to these conditions. The parking is acceptable for another <br /> vehicle as well. Ms. Elizenberry reminds the applicant this permit is not given in <br /> perpetuity and should the dwelling be sold the new owners must obtain their own permit. <br />
