tug+'ry <br />R A 5 <br />VI �� a <br />lown of Mashpce <br />MASHPEE ZONING BOARD OF APPEALS 16 Great Neck load tNot t{2 <br />i9�V�ain�cv^�� :Yf(islApee, .TYI(tssacti, tsetts 0 649 <br />Decision for a Variance <br />RE: Marlene Susienka 160 Wheeler Road <br />Map 49 Parcel 8 <br />V-06-71 <br />A Petition was filed on September 13, 2006 for a Variance from Section 174-31 <br />of the Zoning By-laws for relief from setback requirements in order to expand existing <br />living space and build a screen porch on property is located in an R-5 zoning district at <br />160 Wheeler Road (Map 49 Parcel 8) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on September 22, 2006 and <br />September 29, 2006, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on October <br />11, 2006, at which time the following members of the Zoning Board of Appeals were <br />present and acting throughout: Zella Elizenberry, Robert Nelson, Marshall Brem, <br />Jonathan Furbush and Frederick Borgeson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Marlene Susienka represents herself at this hearing. She is seeking a variance of <br />16 feet on the sideyard in order to expand her existing living space. Her house is only <br />412 square feet and the porch would bring the dwelling up to 1,400 square feet. Her <br />abutting neighbor sits very far back and has no problem with the proposal. Marshall <br />Brem makes a motion to grant the 16 foot variance. <br />GENERAL FINDINGS <br />1. that the subject lot is located at 160 Wheeler Road and contains 26,778 square <br />feet. <br />VARIANCE CRITERIA <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />
