Mashpee Zoning <br />Board of Appeals Carlos Nascimento <br />2 V-06-75 <br />looking for just under 15 feet on the northwesterly side for the variance request. There is <br />some opposition from abutters John Ellis of 5 Autumn Drive and Tom Perry of 6 Autumn <br />Drive. They feel strongly that the proposed garage is too close to the side line for a lot <br />just over 10,000 square feet. They discuss the parking dangers since the existing <br />driveway is such a steep hill and feel a two car garage is too over -powering for the lot <br />and the neighborhood. They discuss other areas to put the garage however, Mr. <br />LaLiberte mentions there is the septic system to consider. They discuss going to* a one <br />car garage however this is not what his customer is looking for. The Board tends to agree <br />with the abutters and is also not happy with the parking situation. After much discussion <br />regarding parking and lack thereof, the Mr. Nelson asks for a vote. Zella Elizenberry <br />wishes to abstain from the voting. The Board votes 4-1 to deny the motion. <br />GENERAL FINDINGS <br />the property is.located at 15 Attaquin Drive and contains 10,560 square <br />feet. <br />VARIANCE CRITERIA <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />not the district in which it is located and that a literal enforcement of the By-laws would <br />involve hardship to the petitioner. <br />SPECIFIC FINDINGS <br />1. The Board determined that the parking for the accessory apartment was <br />not sufficient. <br />2. The variance request for sideyard relief was opposed by two abutters and <br />thus the garage and dwelling above was deemed too large for the lot and <br />neighborhood. <br />
