:.• m <br />w <br />Town of Alashpcc <br />16 Gr-eat ,V�ck (koad <br />D,,E Nlasilpee, .Wassachusetts 0,2640 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for Denial of a Petition for a Variance <br />RE: Thomas and Dale Choate <br />Map I I I Block 198 <br />V-06-81 <br />A Petition was filed on September 22, 2006 for a Variance from Section 174-31 <br />of the Zoning By-laws for frontage relief and lot size relief in order to build a new <br />dwelling on property located in an R-5 zoning district at 43 Pickerel Cove Circle (Mal) 14 <br />Block 7) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on October 6, 2006 and <br />October 13, 2006, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, October 25, 2006 and continued to December 13, 2006, at which time the <br />following members of the Zoning Board of Appeals were present and acting throughout: <br />Robert Nelson, Zella Elizenberry, Marshall Brem, Frederick Borgeson and Jonathan <br />Furbush. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />John Slavinsky represents the applicants at this continued hearing. Applicant has <br />come back to the board showing the house moved back needing no sideyard variances. <br />There are two letters in support of this project that are read into the record by Mr. Nelson. <br />They are from Pat Dempsey and Garret Van Garmet. Mr. Slavinsky gives the Board the <br />overview of why he feels this variance should be granted. This lot already has a house on <br />it and they are requesting like many other similar requests the board has granted, to tear <br />the house down and are in need of frontage relief and lot size relief.
