Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 20, 2006 and <br /> November 3, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 8, 2006, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Jonathan Furbush, Frederick Borgeson and George Bolton <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Daye of Hutker Architects represents the applicant at this hearing. They are <br /> seeking a variance from the front yard setback to build a 24' x 36' garage. The dwelling <br /> is in a cluster development and is similar in design to other abutting homes. The lot <br /> coverage in a cluster subdivision is 30% and this proposal is 23.9%. The Board reviews <br /> the plans and checks on the cluster subdivision rules. The Board makes a motion to grant <br /> a 7.5 foot variance to Driftwood Circle. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter'40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br />
