Mashpee Zoning <br />Board of Appeals Minutes <br />5 December 13. 2006 <br />• NEW HEARINGS <br />Habitat for Humanity of Cape Cod, Inc. Requests a Comprehensive Permit pursuant to <br />G.L.c. 40B. Applicant is proposing to build a single family three bedroom affordable <br />house on property located in an R-5 zoning district at 562 Cotuit Road (Map 16 Parcel <br />36) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Jonathan Furbush and <br />Frederick Borgeson. <br />.John Paonc, a volunteer for Habitat for Humanity of Cape Cod represents the entity <br />seeking a comprehensive permit to build a single Iarnily 3 bedroom house. "file lot in <br />question is at 562 Cotuit Road and is by current zoning by laws, in need of frontage relief <br />and lot size relief. Plans have been submitted as a Chapter 40B so as to keep the title <br />clear. They are looking i'or this to be build as an affordable in perpetuity. Mr. None <br />explains that the person who moves into the house must provide 500 hours of "sweat" <br />equity to help build the home. The Board asks about the shed on the property and Mr. <br />Paone informs them that it will be removed. They will be applying to the Board of <br />Health for all septic issues. An abutter, Ms. Patricia Alivera of 556 Cotuit Road addresses <br />the Board. She submitted a letter to Joyce Mason, Town Manager some time ago asking <br />that she be kept informed should this property be put up for sale since the Town owns it. <br />• She was interested in buying it. "file Town subsequently voted to give this to the Habitat <br />for Humanity since it was their feeling that this was in the best interest of the town. Ms. <br />Alivera is upset that she was not personally informed by Ms. Mason about the land <br />transfer. The Board informed her that this was done at Town Meeting and was she there? <br />She said she was not there. She feels this is where she should start and is upset with the <br />decision. Mr. Nelson asks the board to put this to a motion. Mr. Brem makes a motion to <br />grant the Comprehensive Special Permit. Frederick Borgeson seconds the motion. All <br />agree. So moved. A roll call is taken. Mr. Brem votes yes. Mr. Borgeson votes yes. Mr. <br />Nelson votes yes. Ms. Elizenberry votes yes. Mr. Furbush votes yes. "chis Special Permit <br />is conditioned on a formal Board of Health application and the shed being removed from <br />the property. <br />Robert Bateman: Requests a Variance from Section 174-31 of the Zoning By-law in <br />order to deem lot buildable on property located in an R-3 zoning district at 3 Mohcgan <br />Avenue (Map 72 Parcel 72) Mashpee, MA.
