Ll <br />RIDER ANNEXED TO AND MADE A PARI' OF THE PURCHASE <br />AND SALE AGRFTMENT DATED Ari+ ,� 2004 <br />BETWEEN M� <br />AS "SELLER" <br />M <br />AS "BUYER" <br />Section 16, con0d. <br />The following are to be apportioned or adjusted as of the date of performance of this Agreement <br />(the "Closing Date"), the net of which, on the Closing Date, shall be paid to the parry in whose <br />favor such net apportionment arises: <br />(a) The Seller shall pay the costs of all documentary stamps for the recording of the deed. <br />(b) If, on the Closing Date, the Property or any part thereof, shall be or shall have been <br />affected by a municipal betterment or special assessment or assessments, which are or <br />may become payable in installments, then for the purpose of this Purchase and Sale <br />Agreement all the unpaid installments of any such assessment, which are to become due <br />and payable after the Closing Date; shall be assumed by Buyer without abatement to the <br />purchase price, but shall be subject to adjustment in the same manner as real estate taxes <br />for the tax year in which the Closing Date occurs. <br />(c) If any assessments for public improvements shall ansc subsequent to the execution <br />hereof, and prior to delivery of the deed, and if such election must be made before the <br />Closing Date, Seller will elect to cause the same to be paid over the longest period <br />allowed by law, and such assessments shall be prorated in the same manner as real estate <br />taxes for the tax year in which the Closing Date occurs. <br />(d) U, within six months subsequent to the Closing Date, any of the initial apportionments or <br />adjustments provided .for in this Agreement in Section 16 (a) -(f) hereof, prove to be <br />inaccurate, the party suffering the detriment of such inaccuracy shall notify the other <br />party with details of the inaccuracy, and the patty benefiting from such error shall pay the <br />other party the amount thereof within fifteen (15) days after notice of such inaccuracy. <br />The terms and provisions of this Section 16 shall survive the Closing Date. <br />31. All notices required or which may be given under the terms of this Purchase and Sale Agreement <br />shall be mailed postage prepaid, certified mail, return receipt request4 or if delivered in hand, or <br />delivered by a recognized eoutierservice to the parties as follows: <br />BST99 132W2.065432anlt <br />
