LLC Map 120 Parcels 146 & 147 <br />V-05-04 <br />A Petition was filed on December 8, 2004 for a Variance from Section 174-25.1.9 <br />of the "Zoning By-laws to allow a 180 -foot variance on the dock length limit to allow for <br />construction of a pier, ramp and float on Great River on property located in an R-3 <br />zoning district at 47 and 17 Waterline Drive (Map 12 Parcels 146&147) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on December 31, 2004 and <br />• January 7, 2005, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, February 2, 2005, at which time the following members of the Zoning <br />Board of Appeals were present and acting throughout: James E. Regan III, Robert <br />Nelson, Zella Elizenberry, Frederick Borgeson and Evano Cunha. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of . <br />Mashpee Zoning By-laws. <br />David Sanicki of Cape & Islands Engineering represents the applicant at this <br />hearing. They are seeking a special permit to build a pier, ramp and float on Great River <br />and a variance to exceed the 70 -foot maximum length that is allowed by the by-laws. Mr. <br />Sanicki informs the Board that this property actually has a water VIEW and not a water <br />FRONT that is why they need such a long pier for a walkway access. Gary Locarno, an <br />abutter fully supports this project. Mr. Sanicki informs the Board that the Conservation <br />Commission approved this as well as the Harbormaster and Shellfish.
