15411 <br />Town of Mashpee <br />16 Great deck 4Zoacl A(6i-th <br />MASHPEE ZONING BOARD OF APPEALrhpee,lJlassachusetts 02649 <br />Decision for a Variance <br />Robert and Priscilla Allen <br />53 Seconsett Point Road <br />Map 124 Parcel 16 <br />V-05-02 <br />A Petition was filed on November 30, 2005 for a•Variance from Section 174-25.1.9 of the <br />Zoning By-laws to allow a 16 foot variance on the dock length limit to allow for <br />construction of a pier, ramp and float on Little River on property located in an R-3 zoning <br />district at 53 Seconsett Point Road (Map 124 Block 16) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on December 31, 2004 and <br />January 7, 2005, a copy of which is attached hereto and made a part hereof. <br />• A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 12, 2005, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James E. Regan III, Robert Nelson, Zella <br />Eli-renberry, Richard Guerrera and Evano Cunha. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />David Sanicki of Cape & Islands Engineering represents the petitioner at this <br />hearing. They are seeking a special permit to install a pier, ramp and float and a variance <br />to exceed the 70 -foot maximum length allowed. The water depth is not enough and they <br />must extend the length of the dock by 16 feet in order to achieve the depth they need. <br />They also need to shorten the float for these same reasons. Robert Nelson moves to grant <br />a 16 -foot variance. <br />GENERAL FINDINGS <br />• l . that the subject property is located at 53 Seconsett Point Road and contains <br />12,000 square feet. <br />
