Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on January 28, 2005 and
February 4, 2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, February 2, 2005 and continued until February 23, 3005, at which time the
following members of the Zoning Board of Appeals were present and acting throughout:
Robert Nelson, Zella Elizenberry, Frederick Borgeson and Richard Guerrera.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
David and Donna Paparella represent themselves at this hearing. They were
originally before the Board with a lot coverage variance in addition to the setback relief
being requested. The Board asked them to come back when the total lot coverage of the
proposed addition and the existing dwelling are at 20% or less. The Paparella's have
come back with new plans that show the lot coverage to be at 20% where the Board
wants it to be. They are now requesting relief from the setback requirements in order to
complete these additions. The Board finds this to be reasonable and appreciate that the
lot coverage request can be stricken. The Board moves to grant the setback variances.
