&& d <br /> N R ® 3 <br /> Town of Mashpee <br /> MASHPEE ZONING BOARD OF APPEALS 16 0-cat Neck 'oad,N�)rth, <br /> �tisiA111��0�' I�IaS�2�7C'C�, 1�a,55QC�2L[SC�ttS f)2E74e) <br /> Decision for a Special Permit <br /> RE: John and Joan Malloy 196 Wading Place Road <br /> Map 112 Parcel 50 <br /> SP-05-37 <br /> A Petition was filed on February 16, 2005 by John and Joan Malloy for a Special <br /> Permit under Section 174-25.L9 of the Zoning By-laws to allow for construction of a <br /> pier, ramp and float on property located in an R-3 zoning district at 196 Wading Place <br /> Road (Map 112 Parcel 50) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on March 4, 2005 and March <br /> 11, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 28, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Jolu1 Slavinsky of Cape &Islands Engineering represents the applicant at this <br /> hearing. He is asking for a Special Permit to build a pier, ramp and float. The delay in <br /> this project has been with the Division of Shellfish. It appears that this Division does not <br /> approve any pier and ramp projects, they just don't deny them which is the best an <br /> applicant can get from them. The dock has been moved to a suggested area by Dick York <br /> and float stops have been installed. The Board reviews the plans and finds everything to <br /> be in place along with approval from the Conservation Commission. The Board moves <br /> to grant the special permit.
