if <br />• <br />Mashpee Zoning <br />Board of Appeals <br />Minutes <br />March 23, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes - Wednesday, March 23, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, March 23, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Frederick Borgeson and Richard Guerrera were present along with alternate <br />member Jonathan Furbush. Member Marshall Brem was absent. Alternate Member <br />Evano Cunha was also absent. Also present were two potential ZBA alternates James <br />Reiffarth and Eric Dublirer that were interviewed at the end of the hearing. <br />Mr. Nelson brought the meeting to order at 7:04 p.m. <br />Mr. Nelson had Ms Efizenberry read the last minute continuances that were to take place <br />this evening. (attached is the continuance page) <br />Mr. Nelson would like to announce that there are two new interested applicants for the <br />• ZBA sitting at the end of the table. They will not be acting on anything they are just here <br />to experience the process and will be interviewed at the hearings. <br />Marianne Townsend, Trustee of the MMT Revocable Trust: Requests a Special <br />Permit under Section 174-17 and 174-20 of the Zoning By-laws to alter a pre-existing <br />non -conforming structure and remove and reconstruct a new 4 bedroom dwelling on <br />property located in an R-3 zoning district at 16 Deans Hollow Road (Map 117 Parcel <br />386) Mashpee, MA. <br />Sitting: Robert Nelson. Zella Elizenberry, Frederick Borgeson, Richard Guerrera and <br />Jonathan Furbush. <br />Attorney Kevin Kirrane represents the applicant at this hearing. Also present is architect. <br />Peter Polhemus of Savery, DaSilva and Polhemus. They are requesting a special permit <br />in order to raze and reconstruct a pre-existing noir conforming structure. Attorney <br />Kirrane presents his argument to the board and they review pictures of similar dwellings <br />in the neighbor that currently exist now to show that this proposed structure is not more <br />detrimential to the area. The current structure is 23.11 feet from Deans Hollow — the <br />Popponesset Overlay District dictates that the dwelling must be 25 feet from the street. <br />The new house will comply with that by-law. The current side setbacks are 4.2 feet and <br />the new structure will be 5.7 feet from the lot line therefore making it more conforming <br />for both the setback issues and wetland issues. Additionally, the new de-nite septic <br />• system is a positive addition to the area as well and the total proposed lot coverage would <br />be 18.9%, under the 20% maximum allowed.
