This property is located in <br /> an R-5 zoning district at 146 James Circle (Map 71 Parcel 4) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 25, 2005 and April <br /> 1, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2005 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Susan and Jeffrey Clancy represent themselves at this hearing. They are here to <br /> seek their lot to be deemed buildable and need a variance to do accomplish this due to <br /> contiguous lot ownership. Mrs. Clancy has done a deed search and given the board a <br /> letter from the former Building Inspector, Russ Wheeler who stated the lot was buildable. <br /> The current Building Inspector, Rich Stevens preferred to have the Board grant the relief <br /> for buildability. The Board has granted several of the surrounding lots in this area to be <br /> buildable lots with the same situations. The Board sees no problem with the granting of <br /> the necessary variances to bring this lot up to current zoning. <br />
