10 <br /> c e <br /> wn of <br /> 16 Grew Xeck ko(td <br /> _Uashlice ]Vicessctchusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit - DENIED without Prejudice <br /> RE: Chilton Development Co., Inc. 166 Waterway <br /> Owner: Daisy Orent Map 111 Parcel 89 <br /> SP-05-47 <br /> A Petition was filed on March 22, 2005 for a Special Permit under Sections 174- <br /> 17 and 174-20 of the Zoning By-laws to demolish the existing dwelling and alter a pre- <br /> existing non-conforming structure on property located in an R-3 zoning district at 166 <br /> Waterway (Map 111 Parcel 89) Mashpee, MA. Owner of record: Daisy Orent. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 25, 2005 and April <br /> 1, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2005 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberiy, Frederick <br /> Borgeson, Evano Cunha and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> The Board denied Mr. Grotzke's request for a special permit without prejudice. <br /> Mr. Grotzke came in with plans to replace the dwelling that would put the lot coverage at <br /> 30%. This was extremely unacceptable to the Board and therefore the motion was <br /> denied. <br />
