1IC1516 GTown of Mashpec <br /> re�t,t�/�eckocte�Jl�or tlz <br /> MASHPEE ZONING BOARD OF APPEAL j2,)ee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: John Reardon 55 Amy Brown Road <br /> Map 109 Block 28 <br /> SP-05-50 <br /> A Petition was filed on March 7, 2005 for a Special Permit under Sections 174-17 <br /> and 174-20 of the Zoning By-laws for permission raze, alter and change a pre-existing <br /> non-conforming dwelling on property located in an R-3 zoning district at 55 Amy Brown <br /> Road (Map 109 Block 28) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, March 25, 2005 and April 1, <br /> 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Tuesday, <br /> April 12, 2005 and Wednesday April 27, 2005, at which time the following members of <br /> the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella <br /> Elizenberry, Frederick Borgeson, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represents the client at this hearing. The applicant seeks <br /> to remove the small existing residential structure and replace it with a more substantial <br /> dwelling and a new title V denitrifying septic system. The proposed structure include the <br /> garage will have a footprint of 1,628 square feet which represents a lot coverage of 6.5%. <br /> This dwelling will conform to all current zoning setback requirements. The parcel upon <br /> which the residential structure sits was created in accordance with the provisions of <br /> G.L.C. 41 section 81L on June 12, 1993 or thereabouts. This permits the division of land <br /> around multiple dwellings, on a single lot which pre-date zoning. The lot contains about <br /> 25,000 square feet and has 50 feet of frontage on Amy Brown Road. The lot is a long <br /> h <br />
