Plaintiffs, Anne Levine and Howard Smith, are individuals who reside at 81 <br /> Intervale Road, Newton, Massachusetts. <br /> 2. Plaintiffs are the record owners of the premises numbered 60 Amy Brown Road, <br /> Mashpee, Barnstable County_,Massa.chusetts (hereinafter,"_60 ABR"-). <br /> 3. Defendants are Robert Nelson Zella Elizenberry , Frederick Borgeson, Evano <br /> Cunha, and Jonathan Furbush, as they are the members of the Mashpee Zoning Board of <br /> Appeals, with an address c/o Mashpee Town Hall, of 16 Great Neck Road North, <br /> Mashpee, Massachusetts (the"ZBA"). <br /> Jurisdiction: <br /> 4. Pursuant to Mass. General Laws c. 40 § 17, Plaintiffs hereby appeals that certain <br /> decision of the ZBA dated May 5, 2005,No. SP-05-50 (hereinafter, the"Special <br /> Permit"), a certified copy of which is attached hereto as Tab 1. <br /> 5. Plaintiff avers that 55 ABR and 60 ABR share a common side yard boundary. <br /> Plaintiffs are the direct abutters of 55 ABR and thus have standing to prosecute this <br /> appeal to the Special Permit. <br />
