Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, March 25, 2005 and April 1, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 12, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. and Mrs. O'Connor represent themselves at this hearing. They are seeking to <br /> build an accessory apartment in their basement. They have been to site plan review <br /> although there is a memo from the Fire Department that they have no record of their <br /> application. The Board believes there to be a mix up in record keeping but feels since all <br /> areas have been addressed, they can grant the special permit subject to the approval of the <br /> fire department and any requirements they may make. Frederick Borgeson makes a <br /> motion to grant the special permit. Zella Elizenberry seconds the motion. All agree. So <br /> moved. Reference the mortgage inspection plot plan from Reney, Moran & Tivnan of <br /> Worcester, MA, dated June 8, 2004. <br />
