"�.. `town of Mashpee pH 16 Great Xeck &ad Noah AUIf.IwW ATashpee, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit Re: Gerald and Mary O'Connor 91 Shields Road Map 461 Parcel 1 1 SP -05-39 A Petition was filed on March 22, 2005 for a Special Permit under Section 174- 45.4 of the Zoning By-laws to build an accessory apartment on property located in an R-5 zoning district at 91 Shields Road (Map 461 Parcel 1 1) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, March 25, 2005 and April 1, 2005, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on • Wednesday, April 12, 2005 at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Frederick Borgeson, Jonathan Furbush and Eric Dublirer. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Mr. and Mrs. O'Connor represent themselves at this hearing. They are seeking to build an accessory apartment in their basement. They have been to site plan review although there is a memo from the Fire Department that they have no record of their application. The Board believes there to be a miX up in record keeping but feels since all areas have been addressed, they can grant the special permit subject to the approval of the fire department and any requirements they may make. Frederick Bergeson makes a motion to grant the special permit. Zella Elizenberry seconds the motion. All agree. So moved. Reference the mortgage inspection plot plan from Reney, Moran & Tivnan of Worcester, MA, dated June 8, 2004. •
