• <br />Mashpee Zoning' <br />Board of Appeals Minutes <br />1 April 27, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes —Wednesday April 27, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, April 27, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry, Frederick Borgeson and Marshall Brem were present along with alternate <br />members Jonathan Furbush.and Evano Cunha. Also present were two potential ZBA <br />alternates James Reiffarth and Eric Dublirer. Mr. Richard Guerrera has resigned. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Mr. Nelson would first like to, take a moment and inform the residents that he has <br />regretfully accepted the resignation of long time member Richard Guerrera. He thanks <br />him for his many years of service to the ZBA and wishes him well. <br />Mr. Nelson had Fred Borgeon read the last minute continuances that were to take place <br />• this evening. (attached is the continuance page) <br />Informal Discussion: Margaret Lawton — 89 Industrial Drive — landscaping issues <br />regarding release of $5,000 bond. <br />Mr. Lawton has requested the board return his landscaping bond of $5,000. He has <br />submitted a letter in writing and the Building Inspector has gone out to the property for a <br />final inspection. He has found none of the plantings were done according to the <br />submitted plans. Mr. Lawton tells the Board that they are not allowed to have irrigation <br />and therefore the plans on the original plans would not live without water. The Board <br />would like them to go back to Design Review and submit a new plan that would be more <br />reasonable for their situation and perhaps use some plant that do not need so much water. <br />Mr. Lawton agrees to do this and will be in touch with the Building Inspector. <br />Matthew and Hollv Branton: Request a Variance from Section 174-31 of the zoning <br />by-laws to seek relief from the setback requirements in order to build a 16' x 20 garage <br />on property located in an R-5 zoning district at 98 Park Place Way (Map 37 Parcel 187) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Frederick Borgson, Evano <br />Cunha. <br />• Mr..Mathew Branton represents himself at this hearing. He is seeking a sideyard variance <br />in order to build a 16' x 20' garage. The plans are reviewed by the board and Mr. Brem <br />
