murer� <br /> Town of Nashpee <br /> MASHPEE ZONING BOARD OF APPEALS16 Great,Neck 1�qad,1VV)r-th <br /> LDla.Shpcc, Mossachu ett5 0 649 <br /> Decision for a Variance <br /> Re: Linda Lusczc-Whalen 423 Ashers Path East <br /> Map 61 Parcel 49 <br /> V-05-60 <br /> A Petition was filed on April 19, 2005 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current setback requirements in order to build a farmer's <br /> porch on property located in an R-5 zoning district at 423 Ashers Path East (Map 61 <br /> Block 49) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on April 29, 2005 and May 6, 2005, a copy of which is <br /> attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 11, 2005, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, <br /> Marshall Brem, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Linda Whalen represents herself at this hearing. She is seeking setback variances <br /> in order to build a farmer's porch on the front of her house. The Board discusses the <br /> plans and feels this would enhance the home and the neighborhood. <br /> Mr. Brenn moves to grant the following: <br /> ✓ a 6.0 foot variance in the frontyard <br /> ✓ a 1.0 foot variance on the westerly side <br /> ✓ a 4.0 foot variance in the rearyard <br />
