Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on April 29, 2005 and May
6, 2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 11, 2005, 2004 at which time the following members of the Zoning
Board of Appeals were present and acting throughout: Robert Nelson, Frederick
Borgeson, Marshall Brem, Evano Cunha and Jonathan Furbush.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of
Mashpee Zoning By-laws.
Carmen Shay, Engineer, represents petitioner in this matter. They are seeking a
special permit to raze and replace the existing dwelling with a modular home. The Board
feels that the house that presently sits on the property should basically be condemned it
is such bad shape. A new septic system will be a needed improvement to the area. Mr.
Brem would like to see the old pick up truck removed from the driveway as well. Mr.
Shay will have that taken care of. The Board reviews the plans and sees there are some
zoning issues that may need a variance. There is not enough street frontage nor does the
lot size meet current zoning. It is suggested that Mr. Romero file a variance as well. Mr.
