TV <br /> lown of Mashpee <br /> ail <br /> 16 C,rcal Neck load,,�)rlh, <br /> Mashpce, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Daisy Orent 166 Waterway <br /> Map I I I Parcel 89 <br /> SP-05-63 <br /> A Petition was filed on April 19, 2005 for a Special Permit under Sections 174-17 <br /> and 174-20 of the Zoning By-laws for permission to demolish an existing non- <br /> conforming dwelling and construct a single-family home on property located in an R-3 <br /> zoning district at 166 Waterway (Map I I I Block 89) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on April 29, 2005 and May <br /> 6, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, Wednesday, May 11, 2005 at which time the following members of the <br /> Zoning Board of Appeals were present and acting throughout: Robert Nelson, Frederick <br /> Borgeson, Marshall Brem, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael Grotzke of the Phoenix Group represents the applicant at this hearing. He <br /> is seeking a special permit in order to raze and replace the current structure. The current <br /> structure is a pre-existing non-conforming structure as is the lot when the structure is <br /> razed. The new dwelling, although less non-conforming, will also be non-conforming. <br /> The lot coverage will be reduced to 20% instead of the current 22%. The Board reviews <br /> the plans and is of the opinion that this is the only place for the house to be built. The <br /> Board moves to grant the special permit. <br />
