TV lown of Mashpee ail 16 C,rcal Neck load,,�)rlh, Mashpce, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit RE: Daisy Orent 166 Waterway Map I I I Parcel 89 SP-05-63 A Petition was filed on April 19, 2005 for a Special Permit under Sections 174-17 and 174-20 of the Zoning By-laws for permission to demolish an existing non- conforming dwelling and construct a single-family home on property located in an R-3 zoning district at 166 Waterway (Map I I I Block 89) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on April 29, 2005 and May 6, 2005, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, Wednesday, May 11, 2005 at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, Marshall Brem, Evano Cunha and Jonathan Furbush. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Michael Grotzke of the Phoenix Group represents the applicant at this hearing. He is seeking a special permit in order to raze and replace the current structure. The current structure is a pre-existing non-conforming structure as is the lot when the structure is razed. The new dwelling, although less non-conforming, will also be non-conforming. The lot coverage will be reduced to 20% instead of the current 22%. The Board reviews the plans and is of the opinion that this is the only place for the house to be built. The Board moves to grant the special permit.
