Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation on April 29, 2005 and May 6, 2005, a copy of which is
attached hereto and made a part in the Town of Mashpee, on hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 11, 2005, at which time the following members of the Zoning Board of
Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson,
Marshall Brem, Evano Cunha and Jonathan Furbush.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Gail Welsh represents herself at this hearing. She is seeking a variance in order to
enclose her porch and build a new deck. She is unable to meet the setback requirements
to do this. Mr. Brem mentions the lot coverage is 20.5% and how could she get it down
to 20%. Mr. Nelson mentions that if she cantilevered the deck 2 feet it would reduce the
lot coverage to get it under 20%. She agrees to do this. Everything else seems to be in
order. Mr. Brem moves to grant the following:
✓ a 5.5 foot variance on the westerly side
✓ a 7.0 foot variance on the easterly side
