Mashpee Zoning <br />Board of Appeals Minutes <br />5 May 11, 2005 <br />• These variances are conditioned on plans from Stephen J. Doyle & Associates of East <br />Falmouth, MA, dated April 6, 2005. <br />Daisv Orent: Requests a Special Permit from Sections 174-17 and 174-20 of the zoning <br />by-laws in order to raze, change and alter a pre-existing, non -conforming structure on <br />property located in an R-3 zoning district at 166 Waterway (Map 1 11 Parcel 89) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Frederick Borgeson, Marshall Brem, Evano Cunha and Jonathan <br />Furbush. <br />Michael Grotzke of the Phoenix Group represents the applicant at this hearing. He is <br />seeking a special permit in order to raze and replace the current structure. The current <br />structure is a pre-existing non -conforming structure as is the lot when the structure is <br />razed. The new dwelling, although less non -conforming, will also be non -conforming. <br />The lot coverage will be reduced to 20% instead of the current 22%. The Board reviews <br />the plans and is of the opinion that this is the only place for the house to be built. The <br />Board moves to grant the special permit. Reference plans from The Phoenix Group, <br />originally dated August 16, 2004, and revised on the following dates: August 24, 2004, <br />September 15, 2004, October 25, 2004, November 4, 2004, January 3, 2005, February 14, <br />2005, February 24, 2005, April 18, 2005, and April 27, 2005 as prepared for 166 <br />Waterway. <br />• Raeanne Evdenberg: Requests a Variance from Section 174-31 of the Zoning By-law <br />to seek relief from the setback requirements in order to build a 6' x 26.2' addition to front <br />of the existing dwelling on property located in an R-3 zoning district at 210 Glenneagle <br />Drive (Map 127 Parcel 14) Mashpee, MA. <br />Sitting: Robert Nelson, Frederick Borgeson, Marshall Brem, Evano Cunha and Jonathan <br />Furbush. <br />Applicant is seeking a variance in order to add a garage with a second floor. He shows <br />the board pictures of where the structure is proposed to go and to ask the board for <br />sideyard setback relief. Mr. Brem asks the applicant what the hardship is. The applicant <br />basically says that they are trying to enhance the property and enjoy the view. Mr. Brem <br />does not feel this warrants a hardship. The Board would also like to see what the total lot <br />coverage is for this structure since it is not included in the plans. The Board moves to <br />continue this until June 8, 2005. All agree. So moved. <br />Scott Romero: Requests a Special Permit from Section 174-20 of the Zoning By-laws in <br />order to raze and replace the existing dwelling with a modular home on property located <br />in an R-3 zoning district at 41 Captains Row (Map 90 Parcel 60) Mashpee, MA. <br />Sitting: Robert Nelson, Frederick Borgeson, Marshall Brem, Evano Cunha and Jonathan <br />0 <br />Furbush. <br />
