tU1t'M MashpeeTown of <br /> ]Wishpce, lVassachusetts O 649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Edwin McGuire 410 Monomoscoy road <br /> Map 124 Block 44 <br /> SPR-05-67 <br /> A Petition was filed on May 3, 2005 for a Special Permit under Section 174-17 of <br /> the Zoning By-laws for permission to raze, alter and replace a pre-existing non- <br /> conforming structure on property located in an R-3 zoning district at 410 Monomoscoy <br /> Road Circle (Map 124 Block 44) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 6, 2005 and May 13, <br /> 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was.held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 25, 2005, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Jonathan <br /> Furbush, Evano Cunha, and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents the applicant. They are <br /> seeking a special permit to raze and alter an existing dwelling and they are also seeking <br /> variance relief since they cannot meet the setback requirements, landspace requirements <br /> or frontage requirements to build the house. Mr. Nelson asks Mr. Reiffarth if he has any <br /> concerns sitting on this due to the fact that he lives on Monomoscoy Road. Mr. Reiffarth <br /> has no problems and will continue to sit. This matter was previously granted by the ZBA <br /> in 1997 for a partial demolitign but the time expired on the permit. The Board reviews <br /> the plans and finds this project not to be any more detrimental to the area. The new Title <br /> V system is good for that area. The Board moves to grant the Special Permit. <br />
