Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on May 6, 2005 and May 13,
2005, a copy of which is attached hereto and made a part hereof.
r
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 25, 2005, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Jonathan Furbush, Evano Cunha and James Reiffarth.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
David Sanicki of Cape &Islands Engineering represents the applicant. They are
seeking a special permit to raze and alter an existing dwelling and they are also seeking
variance relief since they cannot meet the setback requirements, landspace requirements
or frontage requirements to build the house. Mr. Nelson asks Mr. Reiffarth if he has any
concerns sitting on this due to,the fact that he lives on Monomoscoy Road. Mr. Reiffarth
has no problems and will continue to sit. This matter was previously granted by the ZBA
in 1997 for a partial demolition but the time expired on the permit. The Board reviews
the plans and finds this project not to be any more detrimental to the area. The new Title
