• <br />• <br />0 <br />Mashpee Zoning <br />Board of Appeals Minutes <br />1 May 25, 2005 <br />TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, May 25, 2005 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, May 25, <br />2005 at 7:00 p.m. at the Mashpee Town Hall. Board Members Robert Nelson, Zella <br />Elizenberry and Evano Cunha were present along with alternate members Jonathan <br />Furbush., James Reiffarth and Eric Dublirer. Board members Marshall Brent and <br />Frederick Borgesorrwere absent. <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Couto Management Grout), LLC: Requests a Special Permit from Sections 174-17, <br />174-24 and 174-25(e)(1) and (2) of the Zoning By-laws in order to alter a pre-existing <br />non -conforming structure, to raze and replace with proposed building to allow for <br />commercial use of property under 10,000 square feet of combined floor space on less <br />than 10 acres in the C-2 district; and use for retail and restaurant to construct a single <br />story building consisting of a Dunkin Donuts restaurant with a drive through window and <br />five additional retail units on property located in a C-2 zoning district at 6 Falmouth <br />Road/Rte 28 (Map 55 Parcel 7) Mashpee, MA. Owner: Marion Augusta <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush and Evano Cunha. <br />Mr. Nelson informs the Board that the applicant has requested a motion to withdraw <br />without prejudice. The Board makes a motion to allow the matter to be withdrawn <br />without prejudice. Zella Elizenberry seconds the motion. All agree. So moved. <br />Punkhorn Realtv LLC: Requests a Special Permit under Sections 174-17 and 174-20 of <br />the zoning by-laws in order to demolish and alter a pre-existing non -conforming structure <br />and reconstruct a new dwelling on property located in an R-3 zoning district at 80 <br />Punkhom Point (Map 100 Parcel 4) Mashpee, MA. <br />Punkhorn Realtv LLC: Requests a Variance from Sections 174-31, 174-32 and 174-33 <br />of the zoning by-laws to seek relief from the lot frontage requirements, setback to the <br />wetlands and from the fire protection by law requiring the said access roadway shall be <br />constructed to a point no less than 150 feet from the furthest point of any building on the <br />lot on property located in an R-3 zoning district at 80 Punkhorn Point (Map 100 Parcel 4) <br />Mashpee, MA. <br />
