Mashpee Zoning <br />Board of Appeals Minutes <br />4 May 25, 2005 <br />• ✓ a 17.5 foot southerly sideyard variance <br />✓ 9.5 foot frontyard setback variance <br />Evano Cunha seconds the motion. All agree. So moved. Reference plans from Cape & <br />Islands Engineering, dated April 25, 2005. <br />Edwin D.McGuire: Requests a Special Permit from Section 174-17 of the Zoning By- <br />laws in order to demolish and rebuild a new structure that will conform to floor hazard <br />construction requirements on property located in an R-3 zoning district at 410 <br />Monomoscoy Road (Map 124 Parcel 44) Mashpee, MA. Previous permit (SP -04-97) was <br />partially demolished. <br />Edwin D. McGuire: Requests a Variance from Section 174-31 of the Zoning By-laws to <br />seek relief from the setback requirements and lot coverage requirements in order to build <br />a 24'.6 x 28' garage, a 24'.20 x 68'.20 house/porch and a 17'.9 breezeway on property <br />located in an R-3 zoning district at 410 Monomoscoy Road (Map 124 Parcel 44) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Evano Cunha, Jonathan Furbush and James <br />Reiffarth. <br />David Sanicki of Cape & Islands Engineering represents the applicant. They are seeking <br />• a special permit to raze and alter an existing dwelling and they are also seeking variance <br />relief since they cannot meet the setback requirements, landspace requirements or <br />frontage requirements to build the house. Mr. Nelson asks Mr. Reiffarth if he has any <br />concerns sitting on this due to the fact that he lives on Monomoscoy Road. Mr. Reiffarth <br />has no problems and will continue to sit. This matter was previously granted by the ZBA <br />in 1997 for a partial demolition but the time expired on the permit. The Board reviews <br />the plans and finds this project not to be any more detrimental to the area. The new Title <br />V system is good for that area. The lot coverage is 17.4%. Mr. Dublirer would like the <br />total lot coverage checked again since his quick calculations don't seem to add up to <br />20%. Mr. Sanicki will have that done again for the board. Evano Cunha moves to grant <br />the Special Permit. Zella Elizenberry seconds the motion. All agree. So moved. Evano <br />Cunha moves to grant the following variances: <br />✓ a 99.75 foot frontage variance <br />✓ a 5 foot sideyard variance <br />✓ a 4.5 foot sideyard variance on the garage side <br />✓ a 26,017 square foot landspace variance <br />Reference plans from Cape & Islands Engineering, dated June 11,2004, revised April <br />21, 2005, and house plans from Northside Designs. <br />0 <br />
