Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on May 20, 2005 and May <br /> 27, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 8, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Eric <br /> Dublirer, Frederick Borgeson, and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Carmen Shay, the engineer is representing the applicant at this hearing. They <br /> were previously granted a special permit to tear down the existing dwelling and during <br /> that hearing realized they needed variance relief for the frontage requirements and <br /> landspace requirements since the entire house is being demolished. So he is now before <br /> the Board to request that relief. The review the plans again and the lot coverage is 16.5% <br /> which is acceptable. Frederick Borgeson moves to grant a 46.47 foot frontage variance <br /> and a 67,840 square foot landspace variance. Zella Elizenberry seconds the motion. Eric <br /> Dublirer votes against the matter. Evano Cunha votes in favor. Robert Nelson votes in <br /> favor. Motion carries by 4-1 vote. <br />
