Mashpee Zoning <br />Board of Appeals Minutes <br />5 6-8-05 <br />• they do not want to subdivide it. Attorney Gamers then says that it has been denied by <br />the planning board and is "landlocked" and cannot be subdivided. Mr. Borgeson asks <br />Attorney Gamer why he did not tell the Board about this earlier since they have been <br />going back and forth about this for 30 minutes? Some hesitation and confusion exists <br />between the Board members and the applicant and her attorney. Mr. Nelson asks the <br />audience for comments. Eunice Lucas of 81 Hoonhole Road: comments that she has <br />concerns with changing and possibly subdividing the property. She mentions that Mr. <br />Alper donated 32 acres of land to the town for purposes of keeping it natural and not for <br />what these people want to do with it. She wants it to remain one piece of property and <br />fears that if two large dwellings such as those being proposed are built on it that some <br />day, it will subdivide. Jean Faxon of 71 Hoonhole Road: she has the same concerns as <br />Ms. Lucas. She doesn't want both large dwellings for fear it will then be subdivided. <br />Ms. Rogers comments that Ms. Faxon's property was just recently subdivided — why is <br />she concerned if she just did the same thing? <br />The Board feels this arguing and "headbutting" is not accomplishing anything since the <br />Board clearly feels that this second detached home is not an accessory dwelling — it is a <br />house. Ms. Elizenberry feels this needs to go to Town Counsel for his opinion. She <br />would like this application reviewed as well as the by-law for the accessory apartments. <br />Although the by law does not specifically require the main dwelling to be attached to the <br />accessory apartment, Zella Elizenberry feels this was the intent of the by-law. Attorney <br />Gamer would like to re -submit a new set of plans that would accommodate the way the <br />• Board would like'this to be done. The parties decide that July 13th would work best for <br />the quorum situation. The matter is continued until July 13, 2005. <br />OTHER BUSINESS: <br />One of the interested applicants for the ZBA has withdrawn his application. <br />The minutes from May 25, 2005 are enclosed in the members folders. <br />Frederick Borgeson moves to adjourn the meeting.
