Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on June 3, 2005 and June 10,
2005, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, June 22, 2005, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Jonathan Furbush, Marshall Brem and Eric Dublirer.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
Patricia Gamache represents herself at this hearing. She is seeking a variance
from several of the setback requirements in order to build a 22' x 13' pergola for her car
to be kept under. Since this is a corner lot, the Board feels she has an extra burden to
adhere to two frontage setback requirements. They feel this will improve the look of the
front area. The Board moves to grant the following variances:
✓ A 14.35 foot setback variance from Fiddler Lane
✓ A 25.6 foot setback variance from Sand Dollar Lane
✓ A 2.1 foot setback variance from the rear
✓ A .8 foot setback variance from the rear
