Mr. Nelson informs the Board that they are only required to look at the bylaw that <br />is being referred to at the hearing and that this matter is for the board of health to <br />authorize. Mr. Brem moves to grant a 44 foot variance to the cranberry bogs. Zella <br />Elizenberry seconds the motion. All agree. So moved. This matter is conditioned on <br />approval from the Board of Health with respect to the nitrogen credit area being <br />addressed and plans from Cape & Island Engineering, dated May 10, 2005, file 176MA, <br />as prepared for Melinda Bradley, 10 Cranberry Lane. <br />Walter S. Wiehtman: Requests a Variance from Section 174-31 of the Zoning By-laws <br />to seek relief from the landspace requirements, frontage requirements and setback <br />requirements in order to build a 40' x 34' house with a 16' x 30' deck on property located <br />in an R-3 zoning district at 419 Monomoscoy Road (Map 124 Parcel 58) Mashpee, MA. <br />WITHDRAWN WITHOUT PREJUDICE <br />Patricia Gamache: Requests a Variance from Section 174-31 of the Zoning By-laws in <br />order to seek relief from setback requirements in order to build a 22' x 13' pergola on <br />property located in an R-3 zoning district at 10 Fiddler Crab Lane (Map 105 Parcel 75) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, Eric Dublirer and Marshall <br />Brem, <br />Patricia Gamache represents herself at this hearing. She is seeking a variance from <br />several of the setback requirements in order to build a 22' x 13' pergola for her car to be <br />kept under. Since this is a corner lot, the Board feels she has an extra burden to adhere to <br />two frontage setback requirements. They feel this will improve the look of the front area. <br />Marshall Brem moves to grant the following: <br />✓ A 14.35 foot setback variance from Fiddler Lane <br />✓ A 25.6 foot setback variance from Sand Dollar Lane <br />✓ A 2.1 foot setback variance from the rear <br />✓ A .8 foot setback variance from the rear <br />Zella Elizenberry seconds the motion. All agree. So moved. Reference plans from Cape <br />& Islands Engineering, dated April 13, 2004 and architectural plans from Archi-tect <br />Associates, dated October 28, 2004. <br />OTHER BUSINESS: <br />Mr. Nelson addresses the Board regarding his conversation with the Town Clerk. He <br />informs the Board that they will continue to have a chairman, vice chairman and clerk <br />when the board is re -organized at the next hearing. This was voted to be ok at the Town <br />Meeting for the three positions. He also mentions that only the full members will be <br />allowed to vote at the reorganization of the board. He also wants to talk to Design <br />Review to see if they agree that the public should not be made to attend those meetings <br />
