1OWN <br /> Vown of Mashpec <br /> 16 G I rcat Nik &a d M)i-th, <br /> MASHPEE ZONING BOARD OF APPEAL�ashpcc, Alassachusetts 02649 <br /> Decision for a Special Permit <br /> Re: Howard Finkel 248 Falmouth Road <br /> Map 62 Parcel 6 <br /> SP-05-80 <br /> A Petition was filed on Julie 16, 2005 for a Special Permit under Section 174-45.4 <br /> of the Zoning By-laws to build an accessory apartment on property located in an R-5 <br /> zoning district at 248 Falmouth Road (Map 62 Parcel 6) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, June 24, 2005, and July 1, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 13, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Howard Finkel represents himself at this hearing. He is seeking a variance to <br /> build a garage with an accessory apartment above it for his parents that will summer here. <br /> He resides in the property which is one of the requirements for an accessory apartment <br /> permit. The Board of Health has issued the comment that he must hook up to town water <br /> and have his septic system inspected if he is to increase the square footage of the <br /> property, which he will be doing. He is aware of all of this and will comply with the <br /> Board of Health's comments. The Board moves to grant the Special Permit. <br />
