Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on June 24, 2005 and July 1, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 13, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Jonathan Furbush, Marshall Brem and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Petitioner is represented by Attorney Kevin Kirrane of Duning and Kirrane. They <br /> are seeking variance relief which was previously granted in 1990, in order to build a new <br /> dwelling on said property. This property is greatly impacted by the wetland resource area <br /> and has greatly varied topography which makes the zoning difficult to comply with. The <br /> parcel has 1.05 acres and more than 200 feet of frontage. Mashpee Conservation has <br /> approved the proposed four bedroom dwelling in the northwest corner due to the <br /> existence of wetland areas and the aforementioned topography problems. Applicant is <br /> seeking relief from the required lot size which is currently 80,000 square feet in the R-5 <br /> zoning area and relief from the 25 foot setback requirements on the side/rear boundary <br />
