i tltl'N <br /> MASHPEE ZONING BOARD OF APPEALS 16 Gi-cat deck4own of Mashpce <br /> oczd PMorth <br /> ' ?�'Ia.sh,pee, I� assachusetts O2649 <br /> �AIJI.E Lam" <br /> Decision for a Special Permit <br /> RE: Thomas and Boiulie Smith 226 Monomoscoy Road <br /> Map 114 Parcel 47 <br /> SP-05-83 <br /> A Petition was filed on June 16, 2005 by Thomas and Bonnie Smith for a Special <br /> Permit under Section 174-25.I.9 of the Zoning By-laws to allow for construction of a <br /> pier, ramp and float on property located in an R-3 zoning district at 226 Monomoscoy <br /> Road (Map 114 Parcel 47) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on June 24, 2005 and July 1, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 13, 2005 and Wednesday, September 28, 2005, at which time the <br /> following members of the Zoning Board of Appeals were present and acting throughout: <br /> Robert Nelson, Zella Elizenberry, Frederick Borgeson, Evano Cunha and James <br /> Reiffarth.. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Edward Pesce of Pesce Engineering and Associates represents Thomas and <br /> Bonne Smith at this hearing. They are seeking a Special Permit for fixed pier, ramp and <br /> float, 69 feet in length. The Harbormaster and the Conservation Commission have <br /> approved the plans. The Board reviews the submitted plans for this project. Attorney <br /> Borelli who represents Joseph Daniele, an abutter at 225 Monomoscoy Road informs the <br /> Board that all parties have reached an agreement and he wishes them well in their project. <br /> The Board makes a motion to'grant the special permit. <br />
