Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on June 24, 2005 and July 1, 2005, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, July 13, 2005 and Wednesday, September 28, 2005, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Frederick Borgeson, Evano Cunha and James Reiffarth.. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. Edward Pesce of Pesce Engineering and Associates represents Thomas and Bonne Smith at this hearing. They are seeking a Special Permit for fixed pier, ramp and float, 69 feet in length. The Harbormaster and the Conservation Commission have approved the plans. The Board reviews the submitted plans for this project. Attorney Borelli who represents Joseph Daniele, an abutter at 225 Monomoscoy Road informs the Board that all parties have reached an agreement and he wishes them well in their project. The Board makes a motion to'grant the special permit.
