Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 1, 2005 and July 8, <br /> 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 13, 2005 and continued until Wednesday, September 28, 2005, at which <br /> time the following members of the Zoning Board of Appeals were present and acting <br /> throughout: Robert Nelson, Zella Elizenberry,Frederick Borgeson, Evano Cunha and <br /> James Reiffarth.. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> This matter was continued from July 13, 2005 for neighbor disputes to be <br /> resolved and amended plans to be submitted. Mr. Ed Pesce from Pesce Engineering <br /> Associates of Plymouth, MA represents the applicant at this hearing. Mr. Pesce presents <br /> the amended plans to the Board for review. He states that everything has been resolved <br /> with Attorney Borelli and his client Joseph Daniele who resides at 225 Monomoscoy <br /> Road, a direct abutter. The plans submitted for the house propose several additions to the <br /> existing dwelling which falls into a pre-existing non-conforming structure but will <br /> maintain 18% lot coverage.
